ANDREW K. WHITMAN

Andrew K. Whitman joins SCHAEFFER COTA ROSEN LLP, with extensive trial, appellate and mediation experience.  For the past 18 years, Mr. Whitman’s practice has focused on the representation of healthcare providers in patient care litigation (primarily defending healthcare facilities but also physicians, individual healthcare professionals, and healthcare entity owners and managers). His 30 years of experience also includes representation of a variety of public entities, professionals, business owners and business entities in general liability, business litigation, personal injury, regulatory compliance, insurance, and contract disputes.

Mr. Whitman is a highly skilled litigator accustomed to vigorously defending complex healthcare cases.  Prior to joining SCHAEFFER COTA ROSEN LLP, he was a partner in one of the Central Coast’s largest healthcare litigation defense firms.   Mr. Whitman has extensive experience defending the unique liability issues presented to the healthcare provider business entity (including claims of “corporate profits over patient care”) and defending healthcare providers against liability from elder and dependent adult abuse claims under Welfare and Institutions Code section 15657.   For nearly two decades he has been at the epicenter of defending the long-term care industry against efforts to erode and eliminate MICRA protections.

Mr. Whitman obtained his law degree from the University of California, Hastings College of the Law.  He obtained a B.A. degree in Political Science from Arizona State University with honors (Magna Cum Laude).  He is admitted to practice law before all California State Courts,  the U.S. District Court for the Central and Eastern Districts of California and the U.S. Circuit Court Appeal for the 9th Circuit.  He is a member of the California Bar Association, Southern California Association for Healthcare Risk Management (SCAHRM) and a former member of the California Association of Healthcare Facilities, Legal Subcommittee.  He has been a frequent speaker at healthcare and legal conferences on a variety of topics.  He is the co-author of a published article on healthcare provider obligations in responding to medical record requests.

Mr. Whitman is a native of California and a resident of Ventura County.  Away from work he enjoys spending time with his wife and kids, cooking and an occasional round of golf.
